Can a tenant assign the tenancy agreement or sublet the rental unit?

Section 34 of the BC Residential Tenancy Act has simplified the legal position for residential premises. A residential tenant may not assign or sublet unless the landlord’s consent in writing. 

If a tenancy agreement is for a fixed term of 6 months or more the landlord may not unreasonably withhold consent. A landlord may never charge for this consent.
